  穿着短裤上班,也能被开除?上海虹口法院近日就审理了这样一起听上去十分奇葩的劳动纠纷案件。不过法官告诉记者,这类劳动争议还不是个案,随着新型用工形态的涌现、无纸化办公模式的出现,劳动者与用工单位之间的各种纠纷,呈现出日益复杂的特征。

  金先生2016年进入公司,由于他不顾公司规定使用私人手机,还穿着短裤上班,多次受到处罚。最终,公司方面解除了金先生的劳动合同。

  Mr. Jin entered the company in 2016 and he was repeatedly punished because he ignored his company’s regulations regarding the use of personal mobile phones and shorts to work. In the end, the company lifted Mr. Kim’s labor contract.

  原告金先生认为:工作期间穿短裤不足以认定为《劳动法》第二十五条的严重违反劳动纪律,解除劳动合同程序不合法,期间未收到被告的处罚通知。

  The plaintiff, Mr. Jin believes that wearing shorts during work is not enough to be considered as a serious violation of labor discipline in Article 25 of the "Labor Law." The termination of the labor contract procedure is illegal, and no notice of punishment from the defendant was received during the period.

  而在公司看来,入职前公司就曾告知过金先生相关规定,且全体员工都在文件上签字确认过。“原告工作期间身穿短裤次数达到三次,符合公司劳动纪律与解除合同的条件。”

  In the company's view, the company had informed Mr. Kim of the relevant regulations before he took charge, and all employees signed and confirmed the documents. “The number of times the plaintiff wore shorts during work reached three times, which is in line with the conditions of the company’s labor discipline and the termination of the contract.”

  为此,金先生向法院起诉,要求用工单位支付报酬以及各项赔偿金,共计2万5千余元。法庭将择期作出一审判决。而在类似的劳动争议案件中,法官发现,随着劳动者与用工单位的关系日渐复杂,不少争议纠纷难以厘清。

  To this end, Mr. Jin sued the court and asked the employing unit to pay compensation and various compensation payments, totaling more than 25,000 yuan. The court will make an optional first-instance judgment. In similar labor dispute cases, the judge found that as the relationship between laborers and employers becomes more complex, many disputes are difficult to clarify.

  而在这些层出不穷的矛盾纠纷中,最让法官头疼的则是新兴行业里的案件,如网约车平台与司机之间的纠纷,由于司机报酬是由奖励、油贴和空驶补贴等几方面复杂组合起来的,再加上用工关系并不牢固,给劳动争议案件的裁审工作带来了挑战。

  In these endless conflicts and disputes, the most troublesome for judges is the cases in emerging industries, such as disputes between online platforms and drivers, as driver compensation is complicated by rewards, stickers, and airline subsidies. The combination, coupled with the lack of employment relations, has brought challenges to the review of labor dispute cases.

  针对这类现象,法院在与劳动仲裁部门合作的同时,也考虑和高校寻求合作,探索新的解决机制。

  In response to this type of phenomenon, the court, in cooperation with the labor arbitration department, also considers seeking cooperation with universities to explore new solutions.
